1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your use of the AffirmNow website at https://affirmnow.in and the AffirmNow mobile application (together, the “Service”), operated by AffirmNow (“AffirmNow”, “we”, “us”, or “our”), based in Pune, Maharashtra, India.
By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with your parent or legal guardian’s consent, and they agree to be bound by these Terms on your behalf. The Service is not directed at children under 13; if you believe a child under 13 has created an account, contact us at info@affirmnow.in and we will delete it.
3. Accounts
- You must provide accurate information (name, email) when you register.
- You must verify your email address before you can sign in; we send a one-time code to your email at registration.
- You are responsible for keeping your password confidential and for all activity that occurs under your account.
- Notify us immediately at info@affirmnow.in if you suspect your account has been compromised.
- You may not create an account on behalf of someone else without their permission, and you may not share your account.
4. Licence to Use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial well-being purposes. All rights not expressly granted are reserved.
5. Your Content
The Service lets you create, upload, and store content, including written affirmations, voice recordings, generated text-to-speech audio, background music files, comments, and profile information (“Your Content”).
You retain ownership of Your Content. You grant AffirmNow a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit, and display Your Content solely as necessary to operate and provide the Service to you. For content you explicitly publish to the community (for example, a public affirmation), you additionally grant us the right to display that content to other users of the Service. This licence ends when you delete the content or your account, except that we may retain copies as required by law or in encrypted backups for a limited period.
You represent and warrant that you have all rights necessary to grant this licence for every piece of content you submit.
6. Uploaded Music & Copyright
If you believe that content on the Service infringes your copyright, please send a written notice to info@affirmnow.in containing:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material on the Service you claim is infringing, with enough detail for us to locate it.
- Your contact information (email, and optionally a phone number).
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.
On receiving a valid notice, we will investigate and, where appropriate, remove the material and terminate the accounts of repeat infringers. If you believe your content was removed in error, you may send a counter-notice to the same address.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
- Upload content that is hateful, abusive, harassing, threatening, sexually explicit, or otherwise objectionable.
- Upload content that infringes anyone’s copyright, trademark, privacy, or other rights.
- Impersonate any person or entity, or misrepresent your affiliation.
- Interfere with, disrupt, or attempt to gain unauthorised access to the Service, our servers, or other users’ accounts.
- Upload malware, viruses, or malicious code.
- Scrape, crawl, or automate access to the Service without our written permission.
- Abuse the community features (spam, harassment, brigading, coordinated reports).
- Reverse-engineer, decompile, or attempt to derive source code from the Service, except as permitted by applicable law.
8. Community & Moderation
Some features of the Service let you make content visible to other users (public affirmations, comments, likes, follows). Content you publish publicly may be seen, played back, shared with, or reported by other users of the Service.
We may, at our discretion and without prior notice, remove or restrict access to content that violates these Terms, respond to user reports, and suspend or terminate accounts of users who violate these Terms or applicable law. We are not obligated to monitor content but reserve the right to do so.
9. Wellness Disclaimer
Do not use AffirmNow to diagnose or treat any health condition, and do not disregard, avoid, or delay obtaining professional advice because of anything you read, hear, or generate on the Service. If you think you may have a medical or mental-health emergency, or if you are in crisis or considering self-harm, please contact a qualified healthcare provider or your local emergency services immediately.
You use the Service at your own risk. To the fullest extent permitted by law, AffirmNow is not responsible for any decision you make, or action you take or fail to take, on the basis of content available on the Service.
10. Intellectual Property
The Service — including the AffirmNow name, logo, website design, mobile app, code, and any built-in content or affirmations we provide — is owned by AffirmNow or its licensors and is protected by copyright, trademark, and other intellectual-property laws. These Terms do not grant you any right to use our name, logo, or branding except as strictly necessary to use the Service. Content submitted by users belongs to those users, subject to the licence in Section 5.
11. Third-Party Services
The Service uses third-party services to function (for example, Google Cloud Text-to-Speech to generate audio from your text, and Google Analytics on the website). We do not control these services and are not responsible for their availability, performance, or content. Your use of any third-party service linked from AffirmNow is governed by that service’s own terms and privacy policy.
12. Payments
The Service is currently offered free of charge. AffirmNow does not process any payments and does not store payment-card information. If we introduce paid features or subscriptions in the future, we will add specific payment terms and give you notice before those terms take effect.
13. Termination
By you: you may stop using the Service at any time, and you may permanently delete your account from inside the Service (Profile → Danger zone → Delete my account). Deletion is described in our Privacy Policy.
By us: we may suspend or terminate your access to the Service — with or without notice — if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will do so.
14. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or secure. We do not warrant that the Service will meet your requirements or produce any particular result.
15. Limitation of Liability
To the fullest extent permitted by law, AffirmNow and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the greater of INR 1,000 or the amount you paid us (if any) in the twelve months preceding the claim. Some jurisdictions do not allow certain of these limitations; in those jurisdictions the limitations apply to the fullest extent permitted by law.
16. Indemnification
You agree to defend, indemnify, and hold harmless AffirmNow and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to (a) your use of the Service, (b) Your Content, including any content you upload that infringes a third party’s rights, or (c) your violation of these Terms or applicable law.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-law principles. You agree that the courts located in Pune, Maharashtra, India shall have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify you in the Service or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
